Terms of Service

1. Acceptance of Terms

By accessing or using IntimaShield ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We understand that you may be going through a difficult time, and we are here to help. These terms exist to protect both you and us so we can serve you as effectively as possible.

2. Service Description

IntimaShield provides protection against non-consensual intimate images (NCII) through a dual-engine system: text-based content discovery, and biometric identity verification for legal authorization.

Content Discovery (Text-Based Search)

  • Targeted Search: We locate unauthorized content by running text searches for your name, handles, and aliases across search engines and our directory of known NCII distribution channels. Discovery is text-only: we never ask you to upload photos, and no image of you is analyzed to find matches.
  • Monitoring: We continuously re-run these targeted searches across major platforms, search engines, and known NCII distribution channels, alerting you immediately if a match is found.

Biometric Authorization Gate

  • Target Identification: You provide the specific URLs or domains where your unauthorized content is being hosted.
  • Identity Verification: To prevent fraudulent takedowns, you complete a secure liveness check via Stripe Identity. This proves who you are, so that only you can authorize a case in your name. It does not decide whether a link shows you; you confirm each link yourself. Your ID and selfie are collected and held by Stripe on Stripe's infrastructure; they are not stored by IntimaShield, no IntimaShield staff member views your images, and the Stripe session is redacted after verification. With your separate written consent, a facial geometry template is created from the verified selfie and used during your case to confirm that submitted content shows you. It is deleted when your case closes, as described in our Biometric Data Policy.
  • Legal Dispatch: Once your identity is verified, we generate legally binding removal notices primarily under the TAKE IT DOWN Act (Public Law 119-12), and where applicable also under DMCA §512 (copyright basis) and FOSTA-SESTA, and dispatch them directly to hosting providers, domain registrars, and platform abuse channels on your behalf.

3. User Obligations

By using IntimaShield, you agree to the following:

  • Truthful Information: You will provide accurate and truthful information when submitting takedown requests, including valid URLs where your unauthorized content is hosted. Misrepresenting ownership of content undermines the legal process and may constitute fraud.
  • Own Content Only: You will only submit URLs for content that depicts you or that you have the legal authority to protect. Attempting to use our biometric verification system to falsely claim ownership of content depicting other people is strictly prohibited and will result in an immediate ban and forfeiture of all fees paid.
  • Biometric Consent: By initiating a takedown request, you consent to completing our 3D liveness verification and automated facial matching process as described in Section 2. You acknowledge that your selfie will be temporarily processed by Stripe Identity and AWS Rekognition for identity confirmation.
  • No Misuse: You will not use the Service to harass, intimidate, or harm others. You will not attempt to reverse-engineer, exploit, or interfere with the operation of the Service.

4. Privacy & Data Handling

Your privacy is at the core of everything we build. IntimaShield uses a minimal-retention architecture designed to comply with the Illinois Biometric Information Privacy Act (BIPA):

  • Content discovery is text-based — we search your name and handles, and your original images are never requested or uploaded for scanning.
  • Verification selfies are collected by Stripe Identity on Stripe's infrastructure for the liveness and document checks. No IntimaShield staff member views your images, and selfies are not stored by IntimaShield.
  • Stripe Identity sessions are redacted after verification completes, removing the liveness images and identity documents from Stripe's infrastructure.
  • AWS Rekognition holds your consent-gated facial geometry template in an isolated collection for the active life of your case or subscription, used only to confirm that content submitted or found shows you. It is deleted when your case closes or your subscription ends, as described in our Biometric Data Policy.

For full details on what we collect, what we don't collect, and how we protect your data, please review our Privacy Policy and Biometric Data Policy.

5. Service Process, Payment & Refund Policy

Takedown Process and Timelines

IntimaShield acts as your authorized legal agent to route TAKE IT DOWN Act removal notices, DMCA §512 notices (where applicable), FOSTA-SESTA notifications, and infrastructure-level abuse reports. Takedown execution times depend on the platform and are not promised. IntimaShield files removal notices with the host and escalates in parallel through the host's CDN, domain registrar and payment processor, with search de-indexing alongside. While the content remains online, notices are re-sent on a recurring cadence (currently about every 21 days), and a case is not closed while its content is up.

By initiating a takedown request, the client acknowledges that no removal timeline is guaranteed.

Service Guarantee and Refund Policy

Your fee covers secure biometric identity verification, legal authorization processing, and the dispatch of legally binding takedown notices to targeted hosting providers. Because IntimaShield specifically targets offshore and non-compliant servers, we guarantee the legal execution of the takedown protocol but cannot guarantee third-party compliance.

  • Identity Verification Refund: If your case fails our internal biometric authorization check (Stripe Identity + AWS Rekognition cross-match), your payment is refunded in full automatically.
  • Escalation Protocol: If a hostile server fails to comply with our legal demands, your case is escalated at no additional cost. Notices are re-sent on the recurring cadence described above, and escalation includes direct de-indexing requests to search engines (Google, Bing) and escalation through the site's infrastructure providers: CDN, domain registrar, and payment processor.
  • No refunds after dispatch: Once takedown notices have been successfully generated and dispatched to the targeted platforms, the service has been rendered and refunds are not available for non-compliance by third-party hosting providers.

Chargeback and Fraud Prevention

Because we incur immediate infrastructure and legal routing costs the moment a takedown protocol is deployed, we maintain a zero-tolerance policy for fraudulent chargebacks. If a client initiates a bank chargeback while a case is open and notices are being routed, or after a successful removal has been verified, IntimaShield will immediately terminate all active legal routing on behalf of that client. Furthermore, we reserve the right to formally withdraw any active legal claims previously submitted on the client's behalf, releasing the hosting provider from their legal obligation to keep the unauthorized content offline.

6. Designated Agent Information

IntimaShield acts as your designated agent for the purposes of submitting removal notices on your behalf. IntimaShield routes notifications primarily under the TAKE IT DOWN Act (Public Law 119-12), and where applicable also under Section 512 of the DMCA (when the content depicts copyrightable material the customer owns), the FOSTA-SESTA regulations, and platform-specific NCII removal programs. By using our Service, you authorize us to act as your representative in issuing removal notices to platforms hosting your content without consent.

Our designated takedown agent can be reached at: help@intimashield.com

7. Limitation of Liability

IntimaShield provides its services on an "as is" and "as available" basis. While we work diligently to monitor and remove NCII, we cannot guarantee that every instance of non-consensual content will be detected or removed. The internet is vast, and some platforms may not comply with takedown requests.

To the maximum extent permitted by law, IntimaShield shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service.

8. Modifications to Terms

We may update these Terms of Service from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. When we make significant changes, we will notify you via the email address associated with your account at least 30 days before the changes take effect.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised terms.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Service shall be resolved in the state or federal courts located in Cook County, Illinois.
